Data Protection Special Report Week becomes digital booklet

Privacy and personal data protection are on the agenda of the National Congress. The Brazilian delay in legislating on the subject is alarming: over 100 countries already have a regulation for the topic and Brazil is excluded from the list of countries considered as “adequate” by the EU to act as receivers of personal data from european citizens, which then blocks the transference of this data to Brazilian companies in some circumstances, debilitating our capacity to innovate and compete in this market.

There are diverse preliminary draft bills that establish rules for the activities of collection and processing of data that are being discussed by congressmen and senators — among them the 5276/2016 bill, a project created by the Executive branch and that, before being sent to parliament, went through extensive public debate on the Internet (as disclosed by InternetLab in our report published earlier this year – in Portuguese).

Focusing on the legislative discussion, we prepared, from July 11-15, the Data Protection Special Report Week. The goal was to shine a light on important topics that the congressmen and senators will have to consider when discussing a new “general rule for data protection”. We dealt with 5 main themes of the law in 5 days, with commentary from representatives of the private sector, the academia and civil society: (i) what is personal data?; (ii) what can authorize the treatment of personal data?; (iii) what is public data?; (iv) Big data: what protections do data subjects have at their disposal?; and (v) enforcement: how should the “competent entity” be?.

To organize the content that was produced on the week, we are now releasing a digital booklet that comes with a new introduction, written by Dennys Antonialli (InternetLab director). The booklet is available in portuguese and in english and will serve as a guideline for the debate in congress, which is urgent. Access!
